These Terms govern your use of this website and any web design and development services you engage Monolith to provide. By using this site or engaging us, you agree to these Terms. If you do not agree, please do not use the site or our services.
Monolith provides web design and development services strictly on a business-to-business (B2B) basis. By engaging us, you warrant that you are acting in a professional, commercial, or business capacity, and not as an individual consumer. Where a client is determined to be a consumer under applicable law, the additional protections set out in Section 04 apply.
This site is provided for information about our services. You agree not to misuse it, attempt to disrupt it, or use it for any unlawful purpose. Content on this site — text, design, code, and branding — belongs to Monolith unless stated otherwise and may not be copied or reused without written permission.
Prices shown on this site and in the quote builder are package and add-on rates. A request through the quote form is not a contract — it starts a conversation. A binding engagement exists only once Monolith issues a written proposal, and you accept it and pay the deposit described below.
The deposit is non-refundable once design or development work has commenced. If you cancel before any work has begun, the deposit is refunded in full within 14 days.
Where this agreement is entered into electronically and you are legally classified as a consumer:
If you explicitly request Monolith to begin work immediately upon payment of the deposit, you acknowledge that you waive your statutory right of withdrawal once performance has begun. This waiver is confirmed in your signed proposal or brief.
Each package includes a defined scope and a set number of revision rounds, confirmed in your proposal and brief. Requests beyond the agreed scope — new pages, features, or significant changes after sign-off — are quoted and billed separately before we proceed.
Upon receipt of payment in full, Monolith formally assigns and transfers to you the copyright in the custom website deliverables created specifically for your project, in accordance with the Copyright and Neighbouring Rights Act of Botswana. The final invoice and subsequent delivery of files together constitute the written instrument of this assignment.
Monolith retains ownership of any pre-existing code, libraries, frameworks, or template components used in the build. These remain licensed to you for use in the delivered project. Third-party components (fonts, open-source libraries, stock assets) remain under their own licences.
Until full payment is received, all work remains the property of Monolith. Monolith may display the completed work in its portfolio unless you request otherwise in writing.
Delivery timelines shown are estimates in business days from the date the deposit clears and Monolith has received all required materials from you. Delays in providing content, feedback, or approvals extend the timeline accordingly.
By engaging Monolith's services, you acknowledge that you have read, understood, and accepted this limitation of liability. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
If you cancel after work has begun, the deposit is retained to cover work already performed. Any work completed beyond the value of the deposit will be invoiced separately. If Monolith is unable to continue a project, we will refund amounts paid for work not yet performed.
Where a deposit is forfeited due to cancellation, Monolith will issue a corresponding invoice in Botswana Pula reflecting the forfeited amount for tax accounting purposes.
These Terms are governed by and construed in accordance with the laws of the Republic of Botswana. Any disputes arising from or in connection with these Terms or any project shall be subject to the exclusive jurisdiction of the courts of Gaborone, Botswana.
